Regulatory enactments:

Law On the Status of those Former U.S.S.R. Citizens who do not have the Citizenship of Latvia or that of any Other State 

Cabinet Regulation No. 1011 “Procedures for Determination of the Status of Non-citizen of Latvia”, adopted on 14 December 2004

1) Persons shall be recognized as non-citizens if they comply with the following conditions:

  1. on 1 July 1992 they were registered in the territory of Latvia regardless of the status of the living space indicated in the registration of residence, or up to 1 July 1992 their last registered place of residence was in the Republic of Latvia, or it has been determined by a court judgment that they have resided in the territory of Latvia for 10 consecutive years until the referred to date;
  2. they are not citizens of Latvia; and
  3. they are not and have not been citizens of another state;
  4. restrictions determined in Section 1, Paragraph three of the Law “On the Status of those Former U.S.S.R. Citizens who do not have the Citizenship of Latvia or that of any Other State”  shall not refer.

Necessary documents:

  1. a submission form;
  2. a curriculum vitae;
  3. a birth certificate or an extract from the register of births (if such exists);
  4. a document certifying the family status (certificate of marriage, a document regarding dissolution of marriage( if such exists);
  5. a document certifying the identity of a person (if such exists);
  6. documents certifying the right of the person to the status of a non-citizen (if such exist); and
  7. a document issued by such foreign competent authority which has been specified by the Office and which certifies that the person is not and has not been a citizen of the relevant state, or a documentary evidence that it is not possible to obtain such document.

       When determining the authority referred to in Paragraph 7 of these Regulations, the Office of Citizenship and Migration Affairs shall take into account the legal links of a person to the relevant state:

1. the state in which the person has been born;
2. the state of the last registered place of residence of the person;
3. nationality of the person’s parents and other family members; and
4. the state whose citizen (national) the relevant person may be or to whose citizenship (nationality) he or she may be admitted.

2) A non-citizen is a child born in Latvia until 31.12.2019, if he or she is not and has not been a citizen of any other country and at the time of his or her birth:

  • one of the parents is a non-citizen, but the other - a citizen of another country, in accordance with mutual agreement of the parents by selecting the status of a Latvian non-citizen for the child.

3) A non-citizen is a child born abroad until 31.12.2019, if he or she is not and has not been a citizen of any other country and at the time of his or her birth:

  • both his or her parents are non-citizens of Latvia;
  • one of the parents is a non-citizen of Latvia, but the other - a stateless person or unknown;
  • one of the parents is a non-citizen, but the other - a citizen of another country, in accordance with mutual agreement of the parents by selecting the status of a Latvian non-citizen for the child.

Necessary documents:

  1. a submission form;

The personal name in Latvian and data of birth of the child, nationality, place of residence (preferably in capital letters) and contact information (e-mail, phone, if any) should be specified in the submission.

  1. a birth certificate or an extract from the register of births;
  2. personal identification document of the parents (passport, identity card);
  3. personal identification document of the child (if any exists);
  4. a document, issued by the competent foreign authority and certifying that the child is not and has not been a citizen of the relevant country (when determining the above-mentioned authority, the legal relations of the child with the relevant country, place of birth of the child and citizenship of parents shall be taken into account).

Important!

The document of registration of civil act shall be translated into Latvian (except, if the document is in English, German, French or Russian and it is submitted to the diplomatic or consular representative office of Latvia or sent via mail from abroad) and legalized in accordance with the procedure determined by regulatory enactments.

Legalization shall not be required for a document, issued by European Union countries, public documents issued by the countries of the European Economic Area, United Kingdom of Great Britain and Northern Ireland (except its overseas territories) or Swiss Confederation, provided for use in Latvia.

Where can you submit the documents?

Currently, documents can be submitted to the Office of Citizenship and Migration Affairs remotely by sending them by post to the Office of Citizenship and Migration Affairs to the address: Čiekurkalna 1.līnija 1, k-3, Rīga, LV-1026.

When sending documents by post, copies of documents must be notarized, except for a copy of an identity document.

If the original documents are sent by post, they will be returned to the address indicated together with the decision taken.

Important!

In case if it will be necessary to make sure on the legal force of the original document or correctness of the derivative of the document, the Office of Citizenship and Migration Affairs may request at any time to present the original document.

In what time period the submitted documents are examined?

The decision shall be made within a time period of one month from the day of receipt of all necessary documents by the Office of Citizenship and Migration Affairs.
