On Tuesday, 22 June, the Cabinet of Ministers (CM) issued the Regulation “Procedure for Inclusion and Updating of Information in the Register of Natural Persons”. The Register of Natural Persons will combine the functionality of the current information system of the Population Register and Civil Register.

The Regulation determines in details the procedure, according to which the state administration authorities, municipalities, courts and sworn notaries will include or update the information in the Register of Natural Persons, how the documents will be stored and used, as well as will determine the procedure, according to which non-citizens of Latvia will submit the documents, substantiating their stay abroad, and the document, certifying that they have not been the citizens of another country.

Besides, the Regulations determine, in what form the Administration of the Saeima, state administration authorities, courts, sworn notaries and natural persons shall provide the information to the Office of Citizenship and Migration Affairs (OCMA) in order the OCMA could update the information in the Register of Natural Persons.

The OCMA and municipalities will include the information in the Register of Natural Persons regarding the citizens of Latvia and non-citizens of Latvia, foreigners, who have received a residence permit in Latvia, a certificate of registration of the citizen of the European Union or certificate of permanent stay of the citizen of the European Union and who have legal relation with Latvia, on the basis of which mutual rights and obligations establish or have been established in the field of immovable property, commercial activity, health, taxes, benefits and education.

When updating the information in the Register of Natural Persons, the date of amendments, legal basis and number of the document confirming the amendments, date of issue, issuing country and issuing authority will be specified. Employees, who will enter the information in the register about a person, will verify the compliance of the information with the personal identification documents, having legal power in Latvia.

It will be possible to provide information to the Register of Natural Persons in presence or electronically.

The Law on the Register of Natural Persons provides that information in the register will be included and updated not only by the OCMA, but also by other state administration authorities, such as municipalities, district (city) courts, when providing the services to a foreigner in the field of the immovable property, commercial activity, health, taxes, benefits, asylum and education.

It is important to note that the choice of persons regarding a prohibition or permit to use their body, tissues and organs after the death will be accumulated in the Register of Natural Persons until 31 January 2022, but starting as of 1 February 2022 the person will have to make this note in the unified health sector electronic information system.
