RETURN DECISIONSWhat is a return decision and in which cases it is issued? In accordance with Paragraph one of Section 41 of the Immigration Law, a return decision shall be issued if a foreigner, while residing in the Republic of Latvia, has breached procedures for the entry and residence of foreigners in the Republic of Latvia specified in regulatory enactments. For instance, a foreigner has breached the period of stay indicated in the visa, resides without a valid visa or residence permit, or has breached the provisions of the visa-free regime. A return decision gives an opportunity to a foreigner to leave the territory of the Republic of Latvia within seven days from receipt of the return decision. By issuing a return decision, re-entry ban to the Republic of Latvia may be set for a period of up to three years. By setting the length of re-entry ban, the Office of Citizenship and Migration Affairs shall evaluate the circumstances of the breach and other factors that might be important in the relevant case. Where to apply for receipt of a return decision? In order to receive a return decision, a foreigner must apply to a territorial division of the Office of Citizenship and Migration Affairs or the Individuals’ Status Control Department, if the foreigner resides in Riga or Riga district, by presenting a valid travel document.
