Foreigner return, if residence conditions in the Republic of Latvia are violated
The procedures of foreigner entry, residence and exit are stated in the Latvian Immigration law.
In the case of a violation during the period of residing stated in the visa, in violation of a visa-free regime or residing in the Republic of Latvia without a valid visa or a residence permit, the foreigner shall receive a voluntary return decision.
Where to submit the documents for a voluntary return decision?
In order to receive a voluntary return decision a foreigner should go to the nearest regional division of the Office of Citizenship and Migration affairs or to the Persons status control division if a foreigner resides in Riga.
What documents should be submitted?
A person submits to the Office of Citizenship and Migration affairs:
- An explanation about infringement of residence conditions in the Republic of Latvia;
- A valid travel document;
- A document which confirms the date of exit (eg. a travel ticket).
In which term a foreigner should depart from the Republic of Latvia?
The term of fulfillment of obligation stated in the voluntary return decision is set to between 7 and 30 days. A foreigner has the right to fulfil such obligation earlier than laid down in the voluntary return decision.
Are there any prohibitions to enter the Republic of Latvia?
The Officer of the Office of Citizenship and Migration affairs is entitled to determine an entry ban in the Republic of Latvia and Schengen territory for a period of 30 days to 3 years.
What are the consequences for an infringement of the voluntary return decision?
If a foreigner has been issued a voluntary return decision but the person had unjustifiably not complied with it an official of the Office of Citizenship and Migration affairs shall take a removal order of the foreigner.
By making a removal order of a foreigner, an entry ban in the Republic of Latvia and Schengen territory is determined to between 30 days and 3 years.
Is receiving of voluntary return decision a payable service?
A voluntary return decision is a cost-free service, but the administrative violation report is issued to a foreigner according to article 190.13 in the Administrative Violations Code of the Republic of Latvia about staying in Republic of Latvia without valid visa, residence permit or valid travel document (depending on the circumstances – a warning is issued or a fine of EUR 350 is imposed).

Voluntary return program
The Riga Office of International Organization for Migration (hereafter, the IOM) operates in Latvia. The IOM is an inter-governmental humanitarian non-political organization, which operates in the field of migration. The Riga Office of the IOM operates a Program of Voluntary return and re-integration under which support is given to people who want to voluntarily return to their country of citizenship and who have no legal basis to reside in Latvia. The Riga Office of the IOM organises and completely disburses flight and other transport costs to the person`s residence, offers support for airport security and passport control and provides that in circumstances where an attendant is required by the IOM who can assist in the flight, pay one-time return allowances, and if necessary provide assistance in order to begin new life in their country.
A foreigner who received a voluntary return decision has the right to apply for aid by the Riga Office of the IOM.
